Why Shariah? And how can Shariah resolve the trust deficit in the construction industry?

To most of the world, Shariah is the Islamic canonical law that Muslims are called to conduct all transactions between people--including in businesses--in compliance with. It governs over three aspects: faith (aqidah), practice or deeds (amal) and behavior (akhlaq).

Why is this good for industry?

Shariah requires businesses to be conducted in an ethical, civic conscious and environmentally sustainable manner from the original sources of the raw materials to the point of final consumption, including the sale of the product. The objective of Shariah is to protect five basic aspects of human life: religion, life, mind, property and progeny--aspects which Islam views as the foundation of a harmonious and peaceful society.

The broad principles within Shariah most applicable to industry are al-muamalat and halalan toyyiban. Al-muamalat (singular: muamalah) emphasize the need for business transactions to apply the concepts of justice, moral obligation, accountability and equality. Halalan toyyiban refers to Shariah-compliant supply chain management, wherein a product is designated Shariah-compliant only if the entire processes involved in its production and distribution follow the requirements of the Shariah.

Khairuddin Abdul Rashid, Kiyoshi Kobayashi, Sharina Farihah Hasan, and Masamitsu Onishi, editors of Concept and Application of Shariah for the Construction Industry: Shariah Compliance in Construction Contracts, Project Finance and Risk Management, believe that an improved understanding of Shariah, its benefits, what it means to be Shariah-compliant, and an increased uptake of shariah compliance by the construction sector will therefore alleviate the trust deficit currently plaguing the construction industry.

This book comprises works by prominent scholars in the field of Shariah and construction. It discusses theories and practices of shariah compliant in construction in three parts: (1) The basic meaning of Shariah and its application for business transactions; (2) Shariah and its application for construction, focusing on contracts for construction works--including sample proposals and innovative models on how Shariah compliant could be applied for construction works' contracts; and (3) the Shariah approach in project finance and risk management and proposes ideas on their application for construction.

Construction practitioners, policymakers and researchers seeking newer ways to improve the conduct of construction business transactions will benefit from the ideas proposed to uplift the image and improve the construction sector. For practitioners whose faith is Islam, undertaking a construction business transaction in a manner that meets the requirements of the Shariah is deemed as performing an act of ibadah (worship).

KHAIRUDDIN Abdul Rashid Sr. Dip., BSc., MSc., Ph.D., MRISM, CQS (BQSM) is Professor at the Department of Quantity Surveying, Kulliyyah of Architecture and Environmental Design and Head, Procurement and Project Delivery System Research Unit, International Islamic University Malaysia (IIUM). He is co-founder and co-editor of the Journal of Quantity Surveying and Construction Business and reviewer of several international refereed journals related to construction. Professor Khairuddin has authored, co-authored, edited and co-edited 14 books and more than 200 technical papers on quantity surveying, procurement, contract administration including Shariah-compliant and Public Private Partnership (PPP) or Private Finance Initiative (PFI).

Kiyoshi KOBAYASHI, BSc., MSc., Eng.D., is Professor at the Graduate School of Management as well as Graduate School of Engineering, Kyoto University. He is a renowned researcher in the fields of Infrastructure Management and Regional Science and a recipient of several awards including the Distinguished Research Awards by Japan Society of Civil Engineers (JSCE) and Fellow Awards by RSA International. He is the President of JSCE and serves on the editorial boards of international journals including the Journal of Infrastructure Systems. He is the author and co-editor of 65 books and over 430 academic reviewed papers.

SHARINA FARIHAH Hasan, Dip., BSc., MSc. (Eng.), Ph.D. (Eng.), is Assistant Professor at the Department of Quantity Surveying, Kulliyyah of Architecture and Environmental Design, IIUM. She is an editorial board member of the Journal of Quantity Surveying and Construction Business. Dr. Sharina has authored and co-authored more than 40 papers in books, book chapters, journal articles and proceedings on quantity surveying, prequalification of contractors, labor market and productivity, and Shariah compliance in construction.

Masamitsu ONISHI, BSc., MSc., Eng.D., is Associate Professor at the Disaster Prevention Research Institute, Kyoto University. He is interested in institutional systems related to the procurement of infrastructure services including contracting and procurement schemes particularly PPPs and disaster risk governance. He is a recipient of the JSCE Young Researcher Award 2006 and Best Paper Award 2008. He has authored and co-authored more than 50 refereed papers and 12 books, chapters in books and proceedings.
